Please read these Terms carefully. By downloading or using CoinCity, you agree to be bound by these Terms. If you do not agree, do not use the App. These Terms form a legally binding agreement between you and CoinCity LLC.
CoinCity is a financial literacy mobile application ("the App") developed and operated by CoinCity LLC, a US limited liability company ("we," "us," or "CoinCity").
These Terms of Service ("Terms") govern your access to and use of the App, including any content, features, and services offered through the App. By creating an account or using the App, you confirm that you are at least 18 years old, are the parent or legal guardian of any child whose profile you create, and have the authority to agree to these Terms.
The App is intended for use by children ages 5 and up under direct parental supervision and account control. Children may not create accounts directly.
New subscribers receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged. You may cancel at any time during the trial period at no cost through your device's App Store or Google Play subscription settings.
Subscriptions are billed monthly through the Apple App Store or Google Play Store, depending on the platform you use. CoinCity LLC does not directly process or store payment card information. All billing is handled by Apple or Google under their respective terms and privacy policies.
You may cancel your subscription at any time through your device's subscription settings:
Cancellation takes effect at the end of the current billing period. You will retain access to the App until the period ends. We do not offer pro-rated refunds for partial billing periods, except where required by applicable law.
Refund requests must be submitted directly to Apple or Google, as all transactions are processed through their platforms. CoinCity LLC does not process refunds directly. Apple's refund policy is available at support.apple.com/billing.
We may change subscription pricing at any time. We will provide at least 30 days' notice of any price increases via email to your registered parent account email address. Price changes will not apply until your next renewal after the notice period.
By using the App, you agree not to:
All content in the App — including but not limited to graphics, text, game mechanics, Professor Hoot character, building designs, sound effects, and the CoinCity name and logo — is owned by or licensed to CoinCity LLC and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, reproduce, modify, distribute, or create derivative works based on our content without our prior written consent.
The App does not currently allow users to create or upload user-generated content. Child profile names and avatars (emojis) that you enter remain yours. You grant CoinCity LLC the right to store and display this information for the purpose of operating the App.
Our collection and use of personal information, including children's personal information subject to COPPA, is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you agree to the Privacy Policy.
As a parent or guardian, you have the right to review, correct, and delete your child's personal information as described in our Privacy Policy.
CoinCity includes a configurable daily screen time limit. The default limit is 60 minutes per day. Parents may adjust this from 30 minutes to 120 minutes through the Parent Dashboard.
CoinCity LLC makes reasonable technical efforts to enforce these limits. However, we cannot guarantee that screen time limits will function correctly in all circumstances (for example, if the device clock is manually altered or if the App is used through third-party emulators). CoinCity LLC is not liable for screen time limit failures resulting from circumstances outside our control.
CoinCity is an educational game designed to introduce financial concepts to children. The financial information and simulations within the App are for educational entertainment purposes only and do not constitute financial advice. We make no representations about the accuracy or completeness of financial concepts as applied to real-world situations.
We do not guarantee that the App will be available at all times or without interruption. We may update, modify, or discontinue any feature at any time with or without notice. We will make reasonable efforts to notify users of significant changes.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COINCITY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to indemnify and hold harmless CoinCity LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your child's use of the App under your account; or (d) your violation of any applicable law or the rights of any third party.
We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to us, other users, or third parties.
You may terminate your account at any time by cancelling your subscription and contacting us at support@coincitykids.com to request account deletion.
Upon termination, your right to use the App ceases immediately. Sections 5, 8, 9, 11, and 12 of these Terms survive termination.
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached within 30 days, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in English in Arlington, Texas. The arbitration award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver: You agree to resolve disputes with us individually, not as a plaintiff or class member in any class, consolidated, or representative proceeding.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
We may update these Terms from time to time. We will notify you of material changes by email to your registered parent account email address at least 30 days before the changes take effect. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the App and cancel your subscription before the effective date of the changes.
